Article 6 of Decree 156/2026/ND-CP (effective from July 1, 2026) amends and supplements Article 22 of Decree No. 31/2019/ND-CP on disciplinary action against people who resolve denunciations, people who verify denunciation content, and people who receive denunciations as follows:
2. The form of disciplinary warning applies to the person resolving the denunciation, the person verifying the content of the denunciation, and the person receiving the denunciation when there is one of the following acts:
a) Having been disciplined in the form of reprimand as prescribed in Clause 1 of this Article and re-offending;
b) Disclose the full name, address, handwriting of the complainant and other information that reveals the identity of the complainant, unless the complainant refuses measures to protect information confidentiality;
c) Deliberately not accepting denunciations, not issuing conclusions on denunciation content; not deciding to handle denunciations according to their authority or not proposing to competent authorities to handle denunciations;
d) Taking advantage of positions and powers in resolving denunciations to commit illegal acts;
e) Threatening, bribing, retaliating, persecuting, insulting the whistleblower;
e) Not applying measures to protect the complainant under its authority leading to the complainant being retaliated against, persecuted causing injury or health damage with a body injury rate from 31% to less than 61%, except for the cases specified in Point b, Clause 3 of this Article.
Thus, from July 1, 2026, the person who resolves a denunciation and discloses the name, address, and handwriting of the denunciator may be disciplined in the form of a warning.
