The Lao Dong Newspaper Legal Consulting Office replied:

Clause 2, Article 1, Decree 251/2025/ND-CP (effective from September 23, 2025) amending Article 23, Decree 172/2025/ND-CP stipulates the order and procedures for disciplinary action against those who have quit or retired as follows:

1. In case there is a decision to discipline the competent authority for a person who has quit or retired and committed a violation during his/her work; based on the decision to discipline the competent authority, the agency advising on personnel work of the competent authority to handle discipline shall propose disciplinary forms, disciplinary action timing and disciplinary action time.

In case the National Assembly Standing Committee is under the disciplinary authority, the Standing Committee of the Delegation Work Committee shall propose the form of discipline, the time of disciplinary action and the time of disciplinary action to the National Assembly Standing Committee for consideration and decision.

In case the competent authority for disciplinary action is under the authority of the Prime Minister, the competent authority for management and use before the time of termination of employment or retirement shall propose disciplinary measures, the time of disciplinary action and the time of disciplinary action to report to the Prime Minister, and at the same time send them to the Ministry of Home Affairs for appraisal and report to the Prime Minister for consideration and decision.

2. In case there is no decision to discipline the competent authority for a person who has quit or retired and committed a violation during his/her work; the competent authority to handle disciplinary action prescribed in Article 22 of this Decree decides on disciplinary action and is responsible for its decision.

3. The competent authority issued a decision on disciplinary action.

Thus, the order and procedures for disciplinary action against cadres and civil servants who have quit their jobs or retired are prescribed as above.
