Clause 2 and Point b, Clause 4, Article 40 of Chapter III of Decree No. 109/2026/ND-CP stipulating penalties for administrative violations in the fields of judicial support; judicial administration; marriage and family; civil judgment enforcement; recovery, bankruptcy of enterprises, cooperatives (effective from May 18, 2026) stipulates violations of regulations on issuance and use of certificates of marital status as follows:
2. A fine of between VND 3,000,000 and VND 5,000 shall be imposed for one of the following acts:
a) Using other person's documents to carry out procedures for issuing a certificate of marital status;
b) Incorrect commitment of marital status to carry out procedures for issuing a certificate of marital status;
c) Providing false information and documents to be granted a certificate of marital status.
4. Remedial measures:
b) Proposing agencies, organizations, and competent persons to consider and handle issued papers and documents due to violations of the provisions of Clause 1 and Points a, b and c Clause 2 of this Article.
Clause 4, Article 4 of Decree No. 109/2026/ND-CP stipulates the level of fines and sanctioning authority for individuals and organizations:
4. The fine level specified in Chapters II, III, IV, V, VI and VII of this Decree is applied to administrative violations of individuals, except for Article 22 and the articles specified in Clause 5 of this Article. In case an organization has administrative violations similar to those of an individual, the fine level is equal to 2 times the fine level for an individual.
Thus, from May 18, 2026, the use of other people's papers to carry out procedures for issuing a certificate of marital status will be fined from 3,000 VND to 5,000 VND for individuals and from 6,000 VND to 10,000 VND for organizations, as well as applying remedial measures according to the above regulations.
