Authority to sanction administrative violations in public asset management

Clauses 21, 22, 23, 24 of Article 1 of Decree 55/2026/ND-CP amending and supplementing a number of articles of Decree No. 63/2019/ND-CP stipulating penalties for administrative violations in the field of public asset management; practicing thrift, combating wastefulness; national reserves; state treasury have been amended and supplemented by Decree No. 102/2021/ND-CP (effective February 9, 2026) as follows:

21. Amending and supplementing Article 30 as follows:

Article 30. Authority to sanction administrative violations of titles in the field of public asset management

1. Director of the Department of Public Asset Management; Heads of organizations under ministries and ministerial-level agencies assigned to perform inspection tasks within the scope of state management of ministries and ministerial-level agencies; Heads of inspection teams established by Ministers and Heads of ministerial-level agencies have the following powers:

a) Warning;

b) A fine of up to 100 million VND;

c) Confiscate exhibits and means of administrative violations;

d) Applying remedial measures specified in Clause 3, Article 4 of this Decree.

2. Directors of Departments; Heads of inspection teams headed by Heads of organizations under ministries and ministerial-level agencies performing state management tasks of ministries and established ministerial-level agencies have the power to:

a) Warning;

b) A fine of up to 80 million VND;

c) Confiscate exhibits and means of administrative violations;

d) Applying remedial measures specified in Clause 3, Article 4 of this Decree”.

22. Supplement point c, clause 1, Article 50 as follows:

c) Inspector; Head of the inspection team within the inspection period.

23. Amending and supplementing Clause 1, Article 51 as follows:

1. The Chairman of the Commune-level People's Committee has the power to:

a) Warning;

b) A fine of up to 50 million VND;

c) Confiscate exhibits and means of administrative violations;

d) Applying remedial measures specified in Clause 5, Article 4 of this Decree”.

Thus, from February 9, 2026, the authority to sanction administrative violations of titles in the field of public asset management is regulated as above.
