According to the provisions of Article 48 of the Law on Social Insurance 2024, it is stipulated as follows:
Solving sick leave benefits
1. Employees are responsible for submitting the documents specified in Article 47 of this Law to the employer. The deadline for submitting documents is no later than 45 days from the date of return to work.
2. Within 07 working days from the date of receiving complete documents from the employee, the employer is responsible for making a list of employees on sick leave with documents submitted to the social insurance agency.
3. Within 07 working days from the date of receiving the complete dossier as prescribed from the employer, the social insurance agency is responsible for handling it; in case of failure to resolve, it must respond in writing and state the reason.
Accordingly, when an employee benefits from sick leave and receives social insurance depends on how long it takes the employee to submit a complete application to the employer and then submit it to the insurance agency and it will be resolved. However, the periods will have to be guaranteed as follows:
