Cao Bang has many shortcomings in the management and use of residential land

The Government Inspectorate has pointed out a series of shortcomings in land use management in Cao Bang.

The Government Inspectorate has issued Notice No. 253/TB-TTCP Announcing the Inspection Conclusion on the management and use of land and the management of exploration, survey, planning, licensing, exploitation, and transportation for construction material mines at Cao Bang Provincial People's Committee.

In which, the Government Inspectorate clearly pointed out about land use planning and plans: In the period before 2020, the allocation of resources for the annual land use planning and plans at the district level was not given due attention, leading to the quality of land use planning, appraisal, and approval not being high.

Land use plans still have a situation of slow approval, adjustment, and supplementation many times due to the forecasting and evaluation of planning, land use plans, and determining the list of investment projects being inaccurate and not feasible.

The results of implementing the Land Use Plan (period 2021 - 2024), as of December 31, 2023, according to the report, there are still 14 land targets not achieved according to the Plan. Some targets have very low or 0% implementation rates, such as: land for cultural and educational facilities, land for economic zones.

The rate of project implementation in the planned year is still low, due to lack of capital preparation, many agencies, units, and investors register land use needs but have not determined the time to allocate funds; the public disclosure of planning and planting planning markers has not been paid attention to implementation.

Land use planning with planning of industries and fields, approved in different periods, still has overlap, is not connected, and lacks synchronization between socio-economic development planning, land use planning, construction planning, planning of industrial parks, residential areas, and rural construction planning; there is a situation where subsequent planning does not fully update the information and data of previously approved planning.

The reason is the lack of close coordination between specialized agencies of the province and People's Committees of districts and cities in the work of preparing, appraising, approving and implementing.

Regarding land allocation, land lease, and land use purpose conversion: The appraisal of land use needs is still slow compared to regulations, leading to the situation that projects are not consistent with district-level land use planning and plans at the time of Decision on investment policy, land allocation, land lease, and land use purpose conversion for some projects.

There is still a situation of some investment projects being slow to put land into use; the encroachment and change of land use purpose of households and individuals not according to planning in some districts has not been detected and handled promptly; land management according to planning and land use plans in some districts has not been valued, and has not met the requirements of state management of land.

The conversion of land use purposes for rice land and forest land of some projects has not been carried out in the correct order and procedures according to regulations; the scope, location, and area of project implementation are not consistent with the investment policy decision.

In addition, the work of issuing certificates of land use rights, ownership of houses and assets attached to land for the first time for households and individuals in urban areas achieved a low rate.

The land database has not been interconnected and unified, there are still many shortcomings and inadequacies, it is not updated, many land plots have not been registered and granted certificates; transfers and purchases are still spontaneous, and supervision and inspection work is still limited.

The responsibility for the above-mentioned shortcomings, omissions, and limitations lies with the Provincial People's Committee, the Department of Natural Resources and Environment, relevant departments and branches in coordination, the People's Committees of districts and Cao Bang city, and relevant units and individuals" - The Government Inspectorate's Notice clearly stated.
