According to the Government Electronic Information Portal on September 8, through inspection work, the Bac Ninh Provincial Inspectorate discovered many violations related to Thuan Thanh Paper Joint Stock Company, Bac Ninh Province.
This is a state-owned enterprise that converted to a joint stock company and in 2002 was granted a land use right certificate by the Provincial People's Committee, with an area of 23,402 m2.
The company then established a housing project for sale in Ho town, Thuan Thanh district (now Thuan Thanh town), with an area of over 1.7 hectares and a total registered investment capital of over 142 billion VND. The project was implemented from the fourth quarter of 2012 to the fourth quarter of 2014.
However, the Inspectorate of Bac Ninh province discovered that when implementing this project, the company had not been permitted by the People's Committee of Bac Ninh province to change the purpose of using the land to build a paper factory to implement a housing project for sale.
The company has not yet been determined by the State agency to collect land use fees for the project.
The inspection conclusion stated that the People's Committee of Thuan Thanh district issued a document approving the investment in the housing development project for sale when the Provincial People's Committee had not yet recognized Thuan Thanh Paper Company as the project investor. The company also did not meet the requirements on equity capital as prescribed and had not yet made an investment guarantee deposit.
Notably, the inspection process also discovered many signs of criminal violations of land management regulations when Thuan Thanh Paper Company signed 81 capital contribution contracts, infrastructure investment capital contribution contracts, land use rights transfer contracts, and receipts for 74 plots of land planned for housing construction for sale and 2,185.5 m2 of land planned for public works construction and collected more than VND 54.5 billion from households and individuals.
According to the inspection agency, the company's implementation of investment cooperation contracts, capital contribution contracts, technical infrastructure investment capital contribution contracts, land use rights transfer contracts, and land allocation to households for construction works to collect more than VND54.5 billion without the Provincial People's Committee's decision to change the land use purpose, without determining the land use fee collection price, and using mobilized capital in violation of regulations; there are signs of violating regulations on land management according to the 2015 Penal Code.
The Inspectorate of Bac Ninh province pointed out that the responsibility for the above violations belongs to Thuan Thanh Paper Company, Ho Ward People's Committee, Urban Management Department, Department of Natural Resources and Environment, Thuan Thanh Town People's Committee, Department of Construction, Department of Natural Resources and Environment.
From there, the Provincial Inspectorate recommended that the Chairman of the People's Committee of Bac Ninh province assign the Department of Home Affairs to preside over and coordinate with relevant agencies to organize a review and advise on handling the responsibilities of collectives and individuals under the disciplinary authority of the Provincial People's Committee; the People's Committee of Thuan Thanh town and the People's Committee of Ho ward consider the responsibilities and handle according to their authority the relevant collectives and individuals.
Notably, the Chief Inspector of Bac Ninh province assigned the head of the inspection team to transfer documents to the Investigation Police Agency , Bac Ninh Provincial Police to continue investigating and clarifying signs of violations of regulations on land management in Article 229 of the Penal Code.
