The Ministry of Home Affairs is seeking opinions on the draft Law on Organization of Local Government amendment. This bill is expected to be submitted to the National Assembly for consideration and comments at the 9th Session.
According to the Draft Law on Organization of Local Government (amended), the determination of the number of provincial People's Council delegates is carried out according to the following principle:
Mountainous and mountainous provinces with 500,000 or less people can elect 50 delegates; with over 500,000 people, an additional delegate can be elected for every 50,000 people, but the total number cannot exceed 90 delegates;
Provinces not falling under the above cases with 1,000,000 or less people can elect 50 delegates; with over 1,000,000 people, for every 75,000 more people, 1 delegate can be elected, but the total number cannot exceed 90 delegates;
Central-level cities with 1,000,000 or less people are elected 70 delegates; with over 1,000,000 people, for every 75,000 more people, 1 delegate is elected, but the total number is not more than 90 delegates;
Hanoi City and Ho Chi Minh City elected 125 delegates.
The draft also states that the determination of the number of People's Council delegates at the grassroots level is implemented according to the following principle:
Communes in mountainous and highland areas with 3,000 or less people are elected to 15 delegates; some with 3,000 or less people to 5,000 people are elected to 20 delegates; some with 5,000 or less people are elected to 25 delegates; some with 10,000 or 15,000 people are elected to 30 delegates; some with over 15,000 people are elected to 1 delegate for every 2,500 people, but the total number is not more than 40 delegates;
Communes not subject to the provisions of Point a of this Clause with 15,000 or less members elected to 20 delegates; with more than 15,000 members to less than 20,000 members elected to 25 delegates; with 20,000 to 25,000 members elected to 30 delegates; with more than 25,000 members, an additional delegate can be elected to each 5,000 members, but the total number cannot exceed 40 delegates;
Wards with 50,000 or less members can elect 30 delegates; with more than 50,000 members, an additional delegate can be elected for every 5,000 members, but the total number cannot exceed 40 delegates;
Special areas in islands with 5,000 or less people are elected to 20 delegates; with 5,000 or less people, 25 delegates are elected; with 10,000 to 15,000 people, 30 delegates are elected; with over 20,000 people, 1 delegate is elected for every 1,000 more people, but the total number is not more than 40 delegates.
