Ministry of Home Affairs proposes expanding the application of urban government model

In the draft Law on Organization of Local Government (amended) recently sent to the Ministry of Justice for appraisal, the Ministry of Home Affairs proposed expanding the application of the urban government model.

The Ministry of Home Affairs emphasized the view that the promulgation of the law aims to ensure unity and synchronization with the "revolution" of streamlining the organization and apparatus of the political system from the central to the grassroots levels.

In this revision, the local government model is designed to "resolutely eliminate intermediate organizations" while promoting the positive results of urban government in recent times.

The Ministry of Home Affairs has asked for the Government's opinion on the local government model proposed in the draft law.

Implementing the 2013 Constitution and institutionalizing the Party's guiding viewpoints in Resolution No. 18-NQ/TW and Resolution No. 27-NQ/TW, the draft Law on Organization of Local Government (amended) specifically stipulates the model of local government organization in urban, rural, island administrative units and special administrative-economic units, in accordance with the characteristics of each locality.

Particularly, the urban government model is an important issue, receiving attention from agencies in the political system.

In order to implement the Party's guiding viewpoint in Resolution No. 06-NQ/TW of the Politburo, which identifies urbanization as an important driving force for rapid and sustainable socio-economic development, and sets the goal of accelerating the pace and improving the quality of urbanization, the Ministry of Home Affairs proposes to expand the application of urban government models such as those of Ho Chi Minh City, Da Nang, and Hai Phong to apply to other centrally-run cities (except Hanoi, which is implemented according to the provisions of the Law on the Capital).

Accordingly, in districts, wards of districts, and commune-level administrative units of cities under centrally-run cities, there is no People's Council but only a People's Committee as a local administrative agency (one-level government).

At the same time, the application of the urban government model to provincial cities will be expanded. Specifically, provincial cities and commune-level administrative units will not organize People's Councils but only organize People's Committees as local administrative agencies.

For cities under centrally-run cities (large-scale urban areas with high independence and autonomy, with specific functions compared to districts) and provincial towns and centrally-run cities (models in the process of urbanization, with many elements between rural and urban areas), a full local government level including People's Councils and People's Committees is still organized to ensure suitability with the characteristics of these urban areas.

Currently, there is Thu Duc city under Ho Chi Minh City and Thuy Nguyen city under Hai Phong city. In the future, there may be more cities under Hanoi city (implemented according to the Law on Capital).

Huong Tra town and Huong Thuy town belong to Hue city; only Son Tay town belongs to Hanoi city is applying the Capital Law, not the Law on Organization of Local Government.

The proposal for a local government organization model as proposed in the draft law aims to ensure the implementation of the Central Government's policy on reducing the level of local government, and more clearly distinguishing functions, tasks, powers, organizational structure and methods of operation suitable to urban and rural characteristics.

Furthermore, it also aims to improve the efficiency, effectiveness and efficiency of state management, streamline the organizational apparatus and reduce staff; promote the urbanization process of localities, especially in areas with rapid development such as provincial cities and cities under centrally-run cities.
