The draft Decree of the Government regulating the organization of specialized agencies under the People's Committees of provinces and centrally run cities and the organization of specialized agencies under the People's Committees of districts, towns and cities under provinces and centrally run cities has just been sent by the Ministry of Home Affairs to the Ministry of Justice for appraisal.
The Ministry of Home Affairs said that the Draft Decree basically inherits the regulations on specialized agencies under the People's Committees at the provincial level; at the same time, it amends and supplements a number of specific regulations.
Regarding the organizational structure of the Department, it includes: Professional and technical departments; Inspectorate (if any); Office (if any); Branches and equivalent organizations (if any); Public service units (if any).
Notably, the Draft Decree supplements Clause 3 on criteria for establishing the Department Inspectorate, in accordance with the provisions of the 2022 Law on Inspection and incorporates opinions from localities in the process of implementing the Decree regulating the organization of provincial-level professional agencies.
The Ministry of Home Affairs proposes the following criteria for establishing the Department Inspectorate:
The Department is established as an inspection agency according to the provisions of Clause 2, Article 26 of the Law on Inspection 2022;
The workload requires a minimum of 5 civil servant positions.
In addition, regarding the number of Deputy Inspectors of the Department, the Draft Decree clearly states that a Department Inspectorate with less than 8 civil servant positions is assigned 1 Deputy Inspector; a Department Inspectorate with 8 civil servant positions or more is assigned no more than 2 Deputy Inspectors.
The draft Decree also clearly states that the Minister of Home Affairs shall submit to the Government a framework for standards for leadership and management positions at the department, branch, division level under the department, division level under the branch under the department and division level under the People's Committee at the district level.
The Minister of Home Affairs also coordinates with ministries in charge of sectors and fields to guide the functions, tasks and powers of specialized agencies under the People's Committees at provincial and district levels.
"Synthesize and monitor the arrangement and organization of specialized agencies under the People's Committees at provincial and district levels. Inspect, examine, and resolve complaints and denunciations according to authority," the draft states the responsibility of the Minister of Home Affairs.
