On November 8, continuing the 8th Session, authorized by the Prime Minister, the Minister of Industry and Trade presented the Report on the draft Law on Chemicals (amended).
Minister of Industry and Trade Nguyen Hong Dien said that the comprehensive and synchronous revision of the provisions of the Law on Chemicals will ensure the inheritance of regulations that are "mature, clear, agreed upon by the majority and verified in practice"; and abolish regulations that are no longer suitable, causing difficulties and obstacles.
At the same time, supplement and develop principles and fundamental regulations suitable to the new situation, associated with promoting decentralization, decentralization, administrative procedure reform and selectively absorbing international experience.
Presenting the Review Report, Chairman of the Committee on Science, Technology and Environment (CST) Le Quang Huy said that the CST basically agrees with the necessity of promulgating the Law on Chemicals (amended).
It is recommended that the drafting agency continue to review the draft Law with other laws and international treaties to which Vietnam is a member during the process of finalizing the draft Law.
Regarding the State's policy in the chemical sector (in Article 6), there are opinions suggesting clarifying the policies of State incentives and State investment; having appropriate, selective, focused and key investment policies to develop the chemical industry.
Clarify specific criteria on capital scale and disbursement progress as stipulated in the draft Law or assigned to the Government for regulation.
Propose to study and supplement regulations on investment in development, training, and recruitment of highly specialized human resources; encourage investment in research and application of chemicals that are less toxic to the environment and human health.
Regarding chemical transportation (in Article 19) and chemical storage (in Article 20), the Committee for Science, Technology and Environment believes that the management of chemicals according to their life cycle has not been clearly defined in the draft Law; it is necessary to study and evaluate the classification of managed chemicals to have a new approach to appropriate management.
Propose to study and supplement regulations on conditions for organizations and individuals to transport chemicals; grant licenses for transporting chemicals; responsibility of organizations and individuals transporting chemicals that cause chemical incidents that affect the environment and human health.
Regarding hazardous chemicals in products and goods in Chapter V, the Committee on Science, Technology and Environment proposed clarifying the functions of relevant agencies such as the Ministries of Industry and Trade, Health, Agriculture and Rural Development related to the management of chemicals in products containing chemicals.
At the same time, research and re-present regulations to comply with the Law on Technical Standards and Regulations and the Law on Product and Goods Quality.
