From the beginning of July 2026, the 2025 Law on Criminal Judgment Enforcement has officially taken effect.
This Law stipulates the principles, order, procedures, organization, tasks, and powers of agencies and competent persons in enforcing judgments and decisions on prison sentences, death sentences, deportations, warnings, non-custodial reforms, prohibitions on residence, probation, conditional parole...
Notably, this law also clearly stipulates the tasks and powers of the People's Committees of communes, commune-level police, and military units in managing, supervising, and educating people who are postponed from serving prison sentences.
In which, the commune-level People's Committee manages, supervises, and educates people who are postponed from serving prison sentences.
The commune-level police have the task of directly assisting the commune-level People's Committee in managing, supervising, and educating people who are postponed from serving prison sentences and have the following tasks and powers.
Receiving dossiers, organizing management, supervision, and education of people who are postponed from serving prison sentences; supplementing documents in the process of management, supervision, and education; handing over dossiers to the provincial-level criminal judgment enforcement agency of the police.
At the same time, request the person who is postponed from serving his prison sentence to fully fulfill his obligations; take educational and preventive measures when that person shows signs of violating the law.
Resolving for people who are suspended from serving prison sentences to be absent or change their place of residence according to the provisions of this Law and the law on residence.
In addition, coordinate with the Vietnam Fatherland Front and member organizations, families and agencies and organizations where the person who is postponed from serving a prison sentence resides in managing, supervising, and educating that person.
Report to the provincial-level criminal judgment enforcement agency to carry out the order and procedures to request the competent Court to cancel the decision to postpone the execution of the prison sentence in cases where the person again commits a new crime, absconds or violates the law, causing adverse effects on security, order, and social safety.
The commune-level police can also report to the provincial-level criminal judgment enforcement agency when the person who is postponed from serving a prison sentence dies, is absent, or changes his place of residence without the consent of this unit.
Monthly, report to the provincial-level criminal judgment enforcement agency on the management, supervision, and education of people who are postponed from serving prison sentences; perform other tasks and powers as prescribed.
For commune-level police chiefs, they are responsible for reporting periodically or at the request of the commune-level People's Committee on the performance of tasks and powers as prescribed.
