On July 23, at the Presidential Palace, the Office of the President held a press conference to announce the President's Order announcing the laws passed by the 15th National Assembly at its 7th Session. Vice Chairman of the Office of the President Pham Thanh Ha chaired the Press Conference.
One of the bills recently passed at the 7th Session of the 15th National Assembly is the Law on Social Insurance (Social Insurance). At the press conference, Deputy Minister of Labor, War Invalids and Social Affairs Nguyen Thi Ha informed about the Law on Social Insurance.
Accordingly, the Social Insurance Law includes 11 chapters and 141 articles; takes effect from July 1, 2025.
Deputy Minister Nguyen Thi Ha said that the Social Insurance Law has new and focused points related to supplementing social pension benefits; Supplementing regulations to increase the connection between social pension benefits and basic social insurance; Expanding subjects to participate and fully benefit from social insurance benefits; Supplementing the right to enjoy sickness and maternity benefits for people working part-time at the commune level; Add maternity benefits to the voluntary social insurance policy.
Besides, it increases the opportunity to receive pension of social insurance participants; Better ensure the right to participate and enjoy social insurance for Vietnamese workers working abroad and foreign workers working in Vietnam; improve investment efficiency of social insurance funds; regulate "reference level" instead of "base salary".
Notably, the Law has had many amendments and supplements in the direction of increasing benefits, increasing attractiveness, and encouraging employees to reserve payment time to enjoy pensions instead of receiving one-time social insurance.
Employees who have stopped participating in social insurance but request it will receive one-time social insurance if they fall into one of the following cases:
Enough age to enjoy pension but less than 15 years of paying social insurance; go abroad to settle;
People suffering from one of the following diseases: cancer, polio, decompensated cirrhosis, severe tuberculosis, AIDS;
People with a working capacity decline of 81% or more; people with particularly severe disabilities;
Employees who pay social insurance before July 1, 2025, after 12 months are not subject to compulsory social insurance but also do not participate;
Voluntary social insurance and social insurance payment period of less than 20 years.
Thus, for people who start participating in social insurance from July 1, 2025 onwards, social insurance will be settled once in the above cases.
Employees who do not enjoy one-time social insurance but reserve the payment period to continue participating have the opportunity to enjoy higher benefits such as: When continuing to participate, they will enjoy benefits with higher benefits; enjoy pension with easier conditions; During the pension period, the social insurance fund pays health insurance; receive monthly benefits when not eligible for pension and under age to receive social pension benefits; During the period of receiving monthly benefits, health insurance is paid by the state budget.
