Regulations on handling inaccurate public information

When detecting that the information created by them has been disclosed inaccurately, the agency or unit is responsible for correcting and disclosing the corrected information.

At the First Session, the 16th National Assembly passed the Law on Access to Information (amended). This Law takes effect from September 1, 2026.

The Law on Access to Information (amended) stipulates the implementation of citizens' right to access information; the responsibilities of state agencies and public non-business units responsible for providing basic and essential public non-business services in ensuring citizens' right to access information.

Article 22 of this Law clearly stipulates the handling of inaccurate public information.

In which case, if information created by themselves and disclosed is inaccurate, the agency or unit is responsible for promptly correcting and disclosing the corrected information.

In case information is discovered to be created by another agency or unit but disclosed inaccurately by themselves, the agency or unit that has disclosed the information is responsible for timely correction and disclosure of the corrected information.

In addition, in case of detecting information created by themselves but disclosed inaccurately by other agencies and units, the agency or unit that creates the information is responsible for requesting the agency or unit that has disclosed the information to promptly correct it, and to disclose the corrected information.

In case citizens believe that the publicly disclosed information is inaccurate, they should propose to the agency or unit that has disclosed that information. At the latest 10 days from the date of receiving the proposal, the agency or unit is responsible for checking the accuracy of the information and responding to citizens; in case it is determined that the publicly disclosed information is inaccurate, it must promptly correct and publicize the information that has been corrected.

The law also clearly stipulates that inaccurate public information in which form must be corrected in that form; and at the same time, information that has been corrected must be publicized on the data portal, electronic information portal, electronic information page, content channel, community page of agencies and units that have publicized inaccurate information.
