The Government has just issued Decree No. 218/2026/ND-CP amending and supplementing a number of articles of Decree No. 158/2024/ND-CP dated December 18, 2024, regulating road transport activities.
Decree No. 218/2026/ND-CP amending and supplementing a number of clauses in Article 7 of Decree No. 158/2024/ND-CP on passenger transport business under contract:
Amending and supplementing point a, clause 4 in the direction of tightening the management of contract cars, and at the same time supplementing regulations prohibiting picking up and dropping off passengers at fixed business locations.
Accordingly, passenger transport business units under contracts are not allowed to confirm bookings for each passenger; are not allowed to sell tickets; are not allowed to collect money; are not allowed to set fixed routes and schedules to serve many passengers or many different transport hirers.
It is not allowed to use transport business vehicles to pick up and drop off passengers at headquarters, branch headquarters, representative offices or at another fixed location leased or cooperated by transport business units, on streets.
Decree No. 218/2026/ND-CP supplements Clause 11, Clause 12 in Article 7 of Decree No. 158/2024/ND-CP stipulating the connection and sharing of data on the contents of passenger transport contracts.
Accordingly, from January 1, 2028, passenger transport business units under contracts must connect and share data on the contents of passenger transport contracts before making trips with the Ministry of Public Security (Traffic Police Department).
Data from the Ministry of Public Security's system (Traffic Police Department) is used to serve patrol, control and other related nghiệp vụ; connect and share data for the Ministry of Construction (Vietnam Road Administration), Ministry of Finance (Tax Department, Customs Department), Provincial People's Committees (Department of Construction) to serve state management according to functions and tasks.
The Ministry of Public Security stipulates and guides the connection, sharing and use of passenger transport contract data.
Decree No. 218/2026/ND-CP also amends and supplements Clauses 5, 6, 7 of Article 12 of Decree No. 158/2024/ND-CP on organizing transport nghiệp vụ training for transport business drivers in the direction of transferring the entire organization of training from transport enterprises to the Department of Construction, and at the same time standardizing the organization process, supplementing the form of computer-based multiple-choice exams, increasing dossier storage time and improving transparency and modernity in inspection and certification.
The Department of Construction is responsible for organizing transport nghiệp vụ training for transport business drivers of transport business units in the province and city managed and meeting the requirements according to regulations.
Form of training: direct or online. Participants in the training must ensure full participation in the learning time to be eligible for testing. At the end of the training program, they must take the test in 120 minutes. The test score at the end of the training program is scored on a scale of 10, the test score from 5 points or more is required;
Centralized testing form: writing tests on paper or doing multiple-choice tests on computers for cases where the Department of Construction has a specialized multiple-choice testing software system, has a question bank and mixes exam questions, and the results are automatically graded and summarized as a basis for evaluating training results.
