Article 23, Decree 352/2025/ND-CP Detailing a number of articles of the Law on Employment on employment services (effective from January 1, 2026), stipulates the responsibilities of enterprises operating employment services as follows:
1. Publicly list certified copies of the original License, work schedule, consulting and job introduction service prices at the headquarters of employment service operations, business branches and business contact information including: Business name, headquarters and branch address, website (if any), email, contact phone number.
2. Within 20 working days from the date the employer announces the recruitment of employees, the enterprise is responsible for updating the results on the National Employment Exchange; monitoring the employment status of employees introduced by the enterprise for at least 01 month or during the labor contract implementation period for cases of labor contract implementation of less than 01 month according to Form No. 04 Appendix I attached to this Decree.
3. Establish, update, and manage labor data for job counseling and job introduction registration; employers register for labor recruitment and implement connection and sharing of information and data according to the guidance of the Ministry of Home Affairs.
4. Ensuring the safety and security of personal data, labor data, and job transaction data in accordance with the law; developing and implementing measures to prevent, detect, warn and prevent acts of fraud and deception in job service activities.
5. Enterprises operating in employment services in the form of e-commerce are responsible for connecting, sharing, and synchronizing information and data on the National Employment Exchange.
6. Within 15 working days from the date of receiving the document from the competent authority on not re-issuing or not extending or revoking the License, the enterprise is responsible for liquidating the employment service contracts being implemented; fulfilling obligations and responsibilities in employment service activities for agencies, organizations and individuals in accordance with the law.
7. Periodically for 06 months (before June 20) and annually (before December 20), report the results of employment service activities to the competent authority through the National Employment Exchange according to Form No. 02 Appendix III issued together with this Decree.
Periodic report for 06 months: Data closing time is calculated from December 15 of the year before the reporting period to June 14 of the reporting period.
Annual periodic report: The data closing time is calculated from December 15 of the year before the reporting period to December 14 of the reporting period.
8. Fully fulfill the responsibilities of enterprises operating employment services according to the provisions of this Decree.
Thus, from January 1, 2026, businesses operating in employment services have the above responsibilities.
