Article 11, Decree 253/2026/ND-CP detailing a number of articles and measures to organize and guide the implementation of the Law on Personal Income Tax (effective from July 1, 2026) stipulates that income from real estate transfers specified in Clause 5, Article 3 of the Law on Personal Income Tax is income from transfer activities, authorization activities that the authorized person has full content such as ownership of real estate according to the provisions of civil law, which are specified as follows:
1. Income from land use right transfer; income from land use right transfer and assets attached to land, in which assets attached to land include:
a) Housing, including housing formed in the future;
b) Infrastructure and construction works attached to land, including construction works formed in the future according to the law on real estate business;
c) Assets that are agricultural, forestry, and fishery products attached to land.
2. Income from transfer of ownership or use of houses, including houses formed in the future according to real estate business law.
3. Income from transfer of land lease rights in land lease contracts (including land with water surface), water surface lease rights.
4. Other income received from real estate transfers in any form, including income from contributing capital with real estate to establish businesses or increase business capital according to the provisions of law.
Thus, from July 1, 2026, income from real estate transfers mentioned above must be subject to personal income tax.
