Point a, Clause 1, Article 151 of the Land Law 2024 (effective from August 1, 2024) stipulates cases where Certificates of land use rights and ownership of assets attached to land are not issued as follows:

1. Land users are not granted a Certificate of land use rights and ownership of assets attached to land in the following cases:

a) Agricultural land used for public purposes as prescribed in Article 179 of this Law;

Article 179 of the Land Law 2024 regulates agricultural land funds used for public purposes as follows:

1. Agricultural land funds used for public purposes that have been established in accordance with land laws over time will continue to be used to serve local public needs.

2. Agricultural land fund used for public purposes of communes, wards and towns for the following purposes:

a) Construction of cultural works, physical training and sports, public entertainment, healthcare, education, markets, cemeteries and other public works invested by the Commune People's Committee, management and use; build houses of gratitude, houses of love, houses of great solidarity;

b) Compensate people whose land is recovered when constructing works specified in Point a of this Clause.

3. For unused land areas for the purposes specified in Clause 2 of this Article, the Commune-level People's Committee shall lease them to local individuals for agricultural production and aquaculture in the form of auction. . The land use term for each lease shall not exceed 10 years.

4. Agricultural land funds used for public purposes of communes, wards and towns are managed and used by the commune-level People's Committee where the land is located and used according to land use planning and plans approved by competent agencies. approval rights.

Thus, from August 1, 2024, agricultural land used for public purposes according to the above regulations will not be granted a Certificate of land use rights and ownership of assets attached to the land.
