The Lao Dong Newspaper Legal Consulting Office replied:
Article 4, Decree 102/2024/ND-CP detailing the implementation of a number of articles of the Land Law stipulates in detail the types of land in the agricultural land group as follows:
1. Land for growing annual crops is land for growing crops that are sown, harvested and end the production cycle for no more than a year, including annual crops with their roots preserved. Land for growing annual crops includes rice land and land for growing other annual crops, specifically as follows:
a) Rice land is a land for a rice crop or more or rice cultivation in combination with other land use purposes that are allowed by law but rice cultivation is the main. Rice land includes specialized land for rice and the remaining rice cultivation land, of which the land specializing in growing rice is land for 02 or more rice crops;
b) Land for growing other annual crops is land for growing annual crops other than rice.
2. Perennial land is land used for growing plants that are planted once, grow for many years and are harvested once or more times.
3. Forestry land is a type of land used for the purpose of managing, protecting and developing special-use forests, protective forests, and production forests according to the provisions of the law on forestry, specifically classified as follows:
a) Special-use forest land is land on which there are special-use forests according to the provisions of the law on forestry, land that has been allocated for the development of special-use forests;
b) Protected forest land is land on which there are protective forests according to the provisions of the law on forestry, land that has been allocated for the development of protective forests;
c) Production forest land is land on which there are production forests according to the provisions of the law on forestry, land that has been allocated, leased, or converted for development of production forests.
4. Aquaculture land is land used specifically for aquaculture purposes.
5. Concentrated livestock land is land for building concentrated livestock farms in separate areas according to the provisions of the law on livestock farming.
6. Salt land is land used for the purpose of producing salt from seawater.
7. Other agricultural land includes:
a) Land for breeding, seedlings and land for growing flowers and ornamental plants; land for growing crops, raising livestock, and aquaculture for the purpose of studying, researching, and experimenting;
b) Land for building greenhouses and other types of houses for agricultural and livestock purposes, including forms of agricultural and livestock farming not directly on the land;
c) Land for construction of works attached to agricultural production areas including land for construction of motels, sheds, and fields to serve workers; land for construction of works for agricultural product preservation, storage of pesticides, fertilizers, machinery, tools, and other auxiliary works.
Thus, the types of land in the agricultural land group are regulated as above.
