Conditions for receiving pension when working capacity is reduced

Article 65 of the Law on Social Insurance 2024 (effective from July 1, 2025) regulates subjects and conditions for receiving pension when reducing working ability

1. Subjects specified in Points a, b, c, g, h, i, k, l, m and n, Clause 1 and Clause 2, Article 2 of this Law, when quitting their job, have a period of compulsory social insurance payment. Forced to receive pension for 20 years or more will be entitled to a pension at a lower level than those who are eligible to receive pension specified in Points a, b and c, Clause 1, Article 64 of this Law if they fall into one of the following cases. This:

a) Have a maximum age of 05 years younger than the age specified in Point a, Clause 1, Article 64 of this Law and have a reduced working capacity from 61% to less than 81%;

b) Have a maximum age of 10 years younger than the age specified in Point a, Clause 1, Article 64 of this Law and have a working capacity decrease of 81% or more;

c) Have at least 15 years of experience working in an occupation or job that is particularly heavy, hazardous, or dangerous on the list of occupations or job that is particularly heavy, toxic, or dangerous established by the Minister of Labor and War Invalids. and Socially issued and have reduced working capacity of 61% or more.

2. Subjects specified in Points d, dd and e, Clause 1, Article 2 of this Law, when quitting their jobs, have paid compulsory social insurance for 20 years or more, and have reduced working capacity from 61 years. % or more, they will receive a pension at a lower level than those who are eligible for pension specified in Points a and b, Clause 2, Article 64 of this Law if they fall into one of the following cases:

a) Have a maximum age of 10 years younger than the age specified in Point a, Clause 1, Article 64 of this Law;

b) Have at least 15 years of experience working in an occupation or job that is particularly heavy, hazardous, or dangerous on the list of occupations or job that is particularly heavy, toxic, or dangerous established by the Minister of Labor and War Invalids. and Social promulgation.

Thus, from July 1, 2025, the conditions for receiving pension when working capacity is reduced are prescribed as above.
