Can Grade 4 participate in security protection at the facility?

The Legal Advice Office of Labor Newspaper replies:

Article 13 of the Law on Forces Participating in national security, public order at the grassroots level (effective from 1.7.2024) stipulates that Vietnamese citizens who have the following wishes and standards, conditions will be considered and selected to participate in the forces participating in national security, public order at the grassroots level:

1. From 18 years old to 70 years old; in cases over 70 years old but ensuring good health, the Chairman of the People's Committee at the commune level will consider and decide based on the proposal of the local police;

2. Having a clear personal history; good moral quality; oneself and family members strictly follow the Party's line, the State's policies, and laws; not being individuals currently prosecuted for criminal offenses, currently serving prison sentences at the commune, ward, or township level, currently undergoing administrative measures, or currently undergoing administrative penalties. In cases where they have completed their prison sentences, they must have their criminal records expunged; in cases where they have completed their administrative penalties, they must have exceeded the time limit for being considered as not having been subject to administrative penalties according to the law;

3. Having a high school diploma or having completed a secondary education program. For border areas, islands, mountainous areas, and areas with extremely difficult socio-economic conditions, ethnic minority areas, it is possible to select individuals who have completed elementary education;

4. Having been resident or temporarily residing for one year or more and regularly living in the place where the citizen submits their application to participate in the forces participating in national security, public order at the grassroots level. In cases specified in Article 15, Clause 3 of this Law, they must be currently residing or temporarily residing in the place where they submit their application to participate in the forces participating in national security, public order at the grassroots level;

5. Having sufficient health according to the certificate of a medical facility established and operating according to the law.

According to the above regulations, you do not meet the educational requirements to participate in the forces participating in national security, public order at the grassroots level.
