Clause 8, Article 8 of Decree 109/2026/ND-CP Regulating penalties for administrative violations in the field of judicial support; judicial administration; marriage and family; civil judgment enforcement; recovery, bankruptcy of enterprises, cooperatives (effective from May 18, 2026), stipulates a fine of 30 million VND to 40 million VND for one of the following acts:
a) Providing or guiding customers to provide fake or untrue documents and evidence;
b) Inciting customers to falsely declare or inciting customers to complain and denounce illegally;
c) Disclose information about the case, about the customer they know while practicing, unless agreed by the customer in writing or otherwise prescribed by law;
d) Colluding and associating with procedural officers, procedural participants, cadres, civil servants, and public employees to violate the provisions of law in resolving cases;
e) Participating in luring, inciting, bribing, coercing others to gather crowds to cause public disorder, committing illegal acts that have not reached the level of criminal prosecution;
e) Providing legal services, legal consulting activities in the name of lawyers or impersonating lawyers to practice law; hanging signs when not yet certified to practice law or not yet joining the Bar Association;
g) Performing other legal service activities not in accordance with the provisions of Article 30 of the Law on Lawyers.
Point b, Clause 9, Article 8 of Decree 109/2026/ND-CP stipulates additional penalties as follows: Revocation of the right to use a practicing lawyer certificate or a practicing lawyer license in Vietnam for 06 months to 09 months for acts violating the provisions of points b, clause 5, clause 6, points c, d and e, clause 7, clause 8 of this Article;
Thus, from May 18, 2026, lawyers who guide customers to provide fake or untrue documents and evidence will be fined up to 40 million VND and will have to bear additional penalties as above.
