Article 37, Chapter III of Decree No. 82/2020/ND-CP stipulating administrative sanctions for violations in the fields of judicial assistance; judicial administration; marriage and family; civil judgment enforcement; bankruptcy of enterprises and cooperatives (hereinafter referred to as "Decree No. 82/2020/ND-CP") stipulates violations of birth registration as follows:
1. A fine of VND 1,000,000 to VND 3,000,000 shall be imposed for the act of erasing or altering the content of documents issued by competent agencies, organizations or individuals for birth registration procedures.
2. A fine of from VND 3,000,000 to VND 5,000,000 shall be imposed for one of the following acts:
a) Falsely stating or testifying about the birth;
b) Providing false information and documents about birth registration;
c) Using other people's documents to register birth.
3. Additional penalties:
Confiscation of evidence is documents and papers that have been erased or altered to distort the content for violations of the provisions in Clause 1 of this Article.
4. Remedial measures:
Recommend competent agencies, organizations and individuals to review and handle birth certificates that have been issued due to violations of the provisions in Clauses 1 and 2 of this Article; documents and papers that have been erased or modified to distort the content specified in Clause 1 of this Article.
Clause 4 and Clause 5, Article 4 of Decree No. 82/2020/ND-CP stipulate the level of fines and the authority to impose fines on individuals and organizations as follows:
4. The fines prescribed in Chapters II, III, IV, V, VI and VII of this Decree shall be applied to administrative violations committed by individuals, except for those prescribed in Clause 5 of this Article. In case an organization commits an administrative violation similar to that of an individual, the fine shall be twice the fine for an individual.
5. The fines prescribed in Articles 7, 8, 9, 16, 17, 24, 26, 29, 33, 39, 50, 53, 63, 71, 72, 73, 74 and 80 of this Decree are fines for administrative violations by organizations.
Thus, those who provide false information about birth registration contents may be fined from VND 3,000,000 to VND 5,000,000 according to the above regulations.
