Lao Dong Newspaper Legal Consulting Office replied:
Clause 1, Article 19 of the 2015 Law on Military Service stipulates that citizens are removed from the military service registration list in the following cases:
a) Death;
b) Past the age of service in the reserve force;
c) Cases specified in Clause 1, Article 13 or Article 14 of this Law.
Clause 1, Article 13 of the 2015 Law on Military Service stipulates that citizens in one of the following cases are not allowed to register for military service:
a) Being prosecuted for criminal liability; serving a prison sentence, non-custodial reform, probation or having completed a prison sentence but not yet had the criminal record cleared;
b) Being subject to educational measures at the commune, ward or town level (hereinafter referred to as commune level) or being sent to a reformatory school, compulsory education facility or compulsory drug rehabilitation facility;
c) Being deprived of the right to serve in the people's armed forces.
Article 14 of the Law on Military Service 2015 stipulates the following subjects exempted from military service registration: People with disabilities, people with serious illnesses, mental illnesses or chronic illnesses as prescribed by law.
Thus, removal from the military service registration list is regulated as above.
