Ban on editing lyrics, music, parody lyrics, editing and deforming the National Anthem

The Ministry of Culture, Sports and Tourism is seeking opinions on the draft Decree regulating the use of the National Anthem of the Socialist Republic of Vietnam.

According to the Ministry of Culture, Sports and Tourism, the National Anthem is used regularly and widely in the political, cultural, and social life of the country, in state ceremonies, foreign affairs activities, national defense, security, education, culture, arts, sports and many other important events. In general, the use of the National Anthem has been seriously and solemnly implemented by agencies, organizations, units and people, contributing to educating patriotism, fostering national spirit, civic responsibility and national pride.

However, through practical organization and implementation, it shows that the use of the National Anthem still has some limitations and inadequacies. The National Anthems and Quoc Thieu songs exploited and used in practice are not truly unified; there are still differences in harmony, arrangement, speed, duration, sound quality and expression methods. In some cases, there is still confusion in distinguishing between singing the National Anthem, performing Quoc Thieu, using recordings or direct performances; rituals performed at some events are not uniform, not truly unified in standards.

Along with that, the rapid development of the online environment, digital platforms, multimedia communication and artificial intelligence gives rise to many new ways of using the National Anthem. Posting, sharing, editing, formatting conversion, changing speed, pitch, orchestration or incorporating the National Anthem into digital products can distort, deform or affect the solemnity and symbolic value of the National Anthem.

In the draft, prohibited acts include: Distorting, editing lyrics, editing music, editing lyrics, cutting or distorting the National Anthem; Performing the National Anthem in a form with content insulting, mocking or disrespecting the solemnity of the National Anthem; Using the National Anthem to oppose the Socialist Republic of Vietnam, infringing upon national and ethnic interests; Using the National Anthem to commit illegal acts; Exercising intellectual property rights or other rights to prevent and obstruct the dissemination and use of the legal National Anthem; Forging the official harmony and arrangement of the National Anthem, National anthem or providing false information about the official version; Taking advantage of the management, provision or use of the National Anthem to illegally profit.

In addition, the draft also stipulates cases where the National Anthem is not allowed to be used: Commercial advertising or activities aimed at directly introducing and promoting the purchase and sale of goods and services; Making ringtones, signal sounds, notification sounds or background music regularly at business establishments, services, entertainment venues; private events, entertainment activities that are not suitable for the solemn nature of the National Anthem.

Another new point in the draft is the use of the National Anthem in the online environment, digital platforms and in media products, which emphasizes: Do not use technology, artificial intelligence or technical means to create fake National Anthem content; modify lyrics, modify music; distort, distort, insult the National Anthem; fake official harmony and arrangement.
