The Social Insurance Law 2024, effective from July 1, 2025, clearly stipulates the suspension and termination of pension and monthly social insurance benefits for 3 groups of subjects.
Accordingly, people who are receiving monthly pensions and social insurance benefits will be temporarily suspended in 3 cases: illegal exit; being declared missing by the Court; when the beneficiary's information cannot be verified.
Compared to the Social Insurance Law 2014, the new regulations are different in the third case.
According to the Social Insurance Law 2014, beneficiaries will have their benefits suspended when "there is a basis to determine that the social insurance benefits are not in accordance with the provisions of law".
According to the Social Insurance Law 2024, this case is regulated as "when the beneficiary's information cannot be verified as prescribed in Point c, Clause 2, Article 11 of this Law".
Thus, if the person receiving the social insurance regime does not cooperate with the social insurance agency to verify the information, when the information cannot be verified, the social insurance regime will be suspended.
The 2024 Social Insurance Law also clearly stipulates 3 cases of termination of pension and monthly social insurance benefits for beneficiaries, including:
- The person who is serving a death sentence or is declared dead by the Court.
- The beneficiary refuses to receive in writing.
- Having a conclusion from a competent authority on the social insurance benefits of beneficiaries that is not in accordance with the provisions of law.
