The Ministry of Home Affairs is drafting a Decree of the Government regulating the organization of specialized agencies under the People's Committees of provinces and centrally run cities and the People's Committees of communes, wards and special zones under provincial levels.
In particular, the Ministry of Home Affairs proposes that specialized departments be organized at the commune level, including:
Office of the People's Council and People's Committee.
This unit has the function of advising and assisting the People's Council and People's Committee at the commune level on: work programs and plans.
Advising and assisting the People's Committee of the commune to perform the function of state management of: the construction and organization of law enforcement, monitoring of law enforcement, inspection and handling of legal documents, dissemination and legal education; Reconciliation in the commune, legal aid, adoption, civil status, authentication, management of law enforcement on handling of administrative violations and other judicial tasks as prescribed by law.
Advising and assisting the People's Committees at the commune level in foreign affairs and border work (for commune-level administrative units with national territorial borders on land, sea and islands).
The second is the Economic Department (for communes, special zones) or the Economic, Infrastructure and Urban Affairs Department (for wards and special zones of Phu Quoc).
This unit has the function of advising and assisting the People's Committees at the commune level in performing the function of state management of: Finance; planning and investment; supporting small businesses, economic cooperation; state financial fund outside the budget.
Advising and assisting the People's Committees at the commune level in performing the function of state management of: Construction planning, architecture; construction investment activities; urban development; urban technical infrastructure (including: water supply, urban drainage; construction materials production facilities; urban lighting, urban trees; cemetery management, martyrs cemeteries; underground urban construction management; general management of urban technical infrastructure); housing; offices; construction materials; traffic; handicrafts; industry; trade.
Advising and assisting the People's Committees at the commune level in performing the function of state management of: Land; water resources; mineral resources; environment; seas and islands (for administrative units with seas and islands); agriculture; forestry; fish processing; irrigation; seafood; rural development; natural disaster prevention and control; poverty reduction; quality and food safety for agricultural products, forestry products, seafood, salt; development of household economy, rural farm economy, agricultural, forestry, fishery cooperative economy associated with rural industries and craft villages.
The third is the cultural - social room. This unit advises and helps the People's Committees at the commune level perform the function of state management of: administrative organization, state affairs; local government, administrative unit boundaries; cadres, civil servants, public employees and public services; administrative reform; associations, non-governmental organizations; emulation and rewards; publications, state archives; youth; labor, wages; employment; social insurance; occupational safety and hygiene; meritorious people; gender equality; ethnic and religious work.
This unit will also help advise on areas such as education and training, health.
In case no professional department is established under the People's Committee at the commune level, the number of commune-level civil servant positions shall be arranged at a maximum of 40 civil servant positions according to the job position performing the functions, tasks and powers of the commune-level administrative unit.
The number of civil servant positions to be arranged for professional departments or commune civil servants according to job positions at the commune level is implemented according to Government regulations. Decentralize to local authorities at the provincial level to decide on the number of civil servant positions at commune-level administrative units from the total number of positions assigned by competent authorities in accordance with local characteristics and conditions.
Pursuant to the provisions of Article 15 of this Decree and the requirements for state management of sectors, fields, and localities to decide on the establishment of appropriate departments.
For communes, wards, and special zones with a population of over 60,000 people, no more than 1 room will be arranged. In particular, Phu Quoc Special Zone is organized with no more than 5 rooms.
Public administrative service centers under the People's Committee of communes shall comply with Government regulations.
