The Chief Justice of the Supreme People's Court has just issued Circular No. 02/2026/TT-TANDTC of the Supreme People's Court stipulating procedures and dossiers for proposing appointment, reappointment, consideration of promotion, transfer, assignment, dismissal, and removal of Judges of the People's Court. The Circular takes effect from January 15, 2026.
In which, Article 10 of the Circular stipulates cases where the proposal to reappoint a Judge of the People's Court is not considered.
At the end of their term, People's Court Judges are not considered for reappointment in the following cases:
During their term, People's Court Judges are disciplined in the form of warning or more or being disciplined with reprimand 2 or more times for violating the regulations of the Party and State in performing the responsibilities of People's Court Judges;
During the term of office of a People's Court Judge, having 2 years of civil servant classification at the level of "not completing tasks" or having 3 years of classification "completing tasks" or below;
Being concluded by competent authorities to violate political standards and not meeting the conditions for appointing Judges of the People's Court;
Being held accountable according to the Regulations on handling the responsibility of people holding judicial titles in the form of not considering reappointing Judges of People's Courts;
Judges wish not to be reappointed for personal reasons.
