In addition, because the demand for car rentals increases during the holidays, customers not only have to book early but also have to deposit to keep the car. Many cases of cancellations when the car delivery date is near make it difficult for the company to handle, leading to the situation of "those who need it don't have it and those who have it give it up". The deposit option in advance allows the renter to be more responsible for the rented vehicle, this deposit will be refunded when the customer returns the car" - Mr. Vuong shared.
However, after having to pay many fines due to the fine system not being updated when the customer returned the car, Mr. Vuong had to apply the option of keeping part of the customer's deposit.
"There have been many cases where, after 5-7 days of terminating the contract with the renter, I suddenly received a notice of a fine caused by the customer during the use of the car. Many customers agreed to cooperate to pay the fine, but many did not respond or blocked the phone number immediately after I notified them. So I had to negotiate with the car renter in advance, apply a measure to withhold a part of the deposit and will refund the customer after about 10 days of checking the fine" - Mr. Vuong informed.
At the Hixe car rental shop located on Pham Tuan Tai Street (Cau Giay, Hanoi), Mr. Ta Quang Tu - operations manager also said that the current increase in fines for traffic violations can easily lead to customers not accepting responsibility, even abandoning their car deposits when violating the law because the fine is much higher than the deposit.
"To limit the situation where customers refuse to pay the fine after the contract has been terminated, the unit chooses to filter the car rental customers right from the start. This is the most effective method that we call "choosing the right person to entrust". Instead of renting in a mass way, the unit will choose a reputable customer group with the ability to pay to rent, from which the problem of paying the fine will be resolved quickly.
In addition, the unit also applies the installation of warning devices for late fines on the vehicle to help customers drive safely and avoid unnecessary late fines. Because of that, the situation of deposit abandonment or "avoiding" responsibility when being fined when renting a car has significantly decreased" - Mr. Tu informed.
Passenger or car owner has to pay the fine?
Sharing with Lao Dong about this issue, Lawyer Luong Huy Ha - Director of Lawkey Law Firm said that in case the vehicle owner proves that he did not commit the violation and helps the police accurately identify the violator, the vehicle owner will not have to pay a fine based on the provisions of Clause 8, Article 80 of Decree 100/2019/ND-CP.
In addition, according to Clause 6, Article 80 of Decree 100/2019/ND-CP, in case a vehicle is legally used by an organization or individual (under a vehicle rental contract or business cooperation contract as prescribed by law) and violates traffic laws, that organization or individual will be subject to penalties as the vehicle owner.
However, in case it is not possible to determine or there is no basis to request the car renter to pay the fine, the car owner is the one responsible for the violation that has been fined.
Therefore, to avoid problems related to fines when renting, during the contract process, the car owner needs to clearly specify the contents related to responsibility before the authorities when driving to cause violations. In case the lessee is not responsible for refunding money or paying fines according to the terms stipulated in the contract, the car owner can file a lawsuit based on the provisions of the law.
