Workers with reduced working capacity can still receive early retirement pensions according to the provisions of law. The 2024 Law on Social Insurance (BHXH) has clearly stipulated the cases and levels of health decline so that workers can retire earlier than the normal retirement age.
According to Article 65 of the Social Insurance Law 2024, employees who are subject to compulsory social insurance, when they have quit their jobs and have had 20 years or more of social insurance contributions, if their working capacity is reduced, they are entitled to early retirement pension at a lower level than those who are old enough to retire normally.
Depending on the degree of health decline and the nature of the work done, workers can retire early from 5 to 10 years, even without waiting for full age.
3 cases of early retirement:
Based on Article 65 of the 2024 Law on Social Insurance, early retirement is divided into 3 main groups:
* Early retirement for a maximum of 5 years
Employees are entitled to retire up to 05 years earlier than the normal retirement age if:
Being reduced in labor capacity from 61% to below 81%; and having enough 20 years of social insurance contribution or more.
* Early retirement for a maximum of 10 years
Employees are entitled to retire up to 10 years early if:
Having a working capacity reduction of 81% or more; and having 20 years or more of social insurance contributions.
* Retirement without considering age
Employees can retire immediately, without waiting for retirement age if they meet sufficient conditions:
Having a working capacity reduction of 61% or more;
Having worked in a particularly heavy, hazardous, and dangerous profession or job for 15 years or more;
Having contributed to social insurance for 20 years or more.
According to Clause 2, Article 169 of the 2019 Labor Code, the retirement age under normal working conditions is being gradually adjusted to increase. Depending on the year and gender, the specific retirement age will be different. Based on this retirement age, workers with reduced working capacity will be deducted 5 years or 10 years to determine the time to retire early.
Workers with reduced working capacity may retire earlier than the prescribed age by 05 to 10 years, or even do not need to wait for sufficient age if they have worked for a long time in particularly heavy, hazardous, and dangerous environments.
