Court orders lottery ticket owner who won 2 billion VND to pay court fees

HUE - The owner of the lottery ticket that won the special prize of 2 billion VND was required to pay an advance payment of 36 million VND in court fees according to regulations.

On December 26, lawyer Nguyen Van Ky - Director of Ky Nguyen and Associates Law Firm (Hue) said that the People's Court of Huong Thuy town (Thua Thien Hue province) has just announced the payment of advance court fees for Ms. Nguyen Thi Nga (residing in Thang Binh district, Quang Nam province, the character's name has been changed).

Accordingly, after reviewing the civil lawsuit petition (for the defendant, Thua Thien Hue Lottery One Member Co., Ltd.) and the accompanying documents and evidence; it is found that the case according to the petition of the plaintiff is under the jurisdiction of the People's Court of Huong Thuy town and the plaintiff is subject to the case of having to pay an advance court fee according to the provisions of law.

Pursuant to Article 146 and Clause 1, Clause 2, Article 195 of the Civil Procedure Code, Huong Thuy Town People's Court hereby informs Ms. Nga: Within 7 days from the date of receipt of this notice, she must go to the headquarters of the Civil Judgment Enforcement Agency of Huong Thuy Town, address: No. 49 Song Hong (Phu Bai Ward, Huong Thuy Town, Thua Thien Hue Province) to pay the advance payment of first-instance civil court fees of 36 million VND and submit to Huong Thuy Town People's Court the receipt for the advance payment of first-instance civil court fees.

After 7 days from the date of receipt of this notice, if you do not submit to the court the receipt of the advance payment of court fees without a valid reason, the court will return the petition to you according to the provisions of Point d, Clause 1, Article 192 of the Civil Procedure Code.

Also according to lawyer Nguyen Van Ky, regarding the above case, the Criminal Techniques Department of Thua Thien Hue Provincial Police has announced the provision of appraisal results of the lottery ticket with the winning number 386552 (F), issued by Thua Thien Hue Provincial Lottery State Company Limited on October 14, winning the special prize of 2 billion VND at the request of the owner, Ms. Nguyen Thi Nga.

The Criminal Techniques Department of Thua Thien Hue Provincial Police refused to notify the appraisal results as requested by Ms. Nga on the grounds that she was not the subject requesting the appraisal, and the appraisal agency had the obligation not to notify Ms. Nga of the appraisal results, unless the subject requesting the appraisal agreed in writing.

Lawyer Ky said that the police agency's refusal to provide the appraisal results to Ms. Nga was correct because she was not the one who requested it.

Mr. Ky is one of two lawyers from Ky Nguyen and Associates Law Firm participating in protecting the legal rights and interests of the plaintiff, Ms. Nguyen Thi Nga, in the lawsuit requesting the Thua Thien Hue Provincial Lottery State-owned Company to pay the lottery winnings of 2 billion VND.

The lawsuit is being considered and accepted by the People's Court of Huong Thuy town, Thua Thien Hue province according to regulations.
