On August 23, the Traffic Police Department of Ho Chi Minh City Police (PC08) said that from December 2023 until now, through the work of investigating and resolving traffic accidents, the police of districts and Thu Duc city belong to the Police. Ho Chi Minh City has prosecuted 13 criminal cases due to drivers violating road traffic regulations causing accidents.
Among them there are many typical cases, such as a traffic collision between a motorbike and a truck (with a crane) causing the motorbike owner to die on the spot.
Accordingly, at 9:45 p.m., December 31, 2023, a truck (with crane) controlled by Mr. NVT (born in 1978, residing in Hau Giang province) was circulating on Nguyen Van Bua Street (Hamlet 4, Xuan Thoi Son Commune, Hoc Mon district) in the direction from National Highway 22.
When arriving at Cau Lon, he collided with a motorbike driven by Mr. NVS (born in 1981, living in Dong Thap province) traveling in the opposite direction. As a result of the accident, Mr. NVS died on the spot. Two vehicles involved were damaged.
Based on the results of the scene examination, vehicle examination, inspection conclusions and other documents, it is shown that the cause of the above accident was due to the mixed errors of Mr. NVS and Mr. NVT.
In particular, Mr. NVS did not have a driver's license, had an alcohol concentration of 360.13mg/100ml of blood, drove on the left side of the road and swerved across the street without paying attention, giving way to vehicles running on a straight road. Mr. NVT was at fault for driving the car before and when the accident occurred, exceeding the allowed speed (exceeding 50km/h).
During the investigation process, the Police Investigation Agency of Hoc Mon District Police determined enough grounds to prove that NVT's behavior had enough elements to constitute the crime of "Violation of regulations on road traffic participation"; transferred the entire case file along with the investigation conclusion to the Hoc Mon District People's Procuracy to request the prosecution of defendant NVT according to the provisions of law.
Another accident occurred in the early morning of January 25, 2024, driven by Mr. HVK (born in 1997, residing in Binh Phuoc province), behind the vehicle carrying HNP (born in 1984, residing in Binh Chanh district, Ho Chi Minh City). traveling on An Phu Dong bridge (Ward 5, Go Vap district) heading from Nguyen Thai Son street to District 12, he fell and caused an accident.
The accident caused Mr. HNP sitting in the back to die on the spot. Mr. HVK was injured and was taken to the hospital for emergency treatment.
The cause of the above traffic accident was that Mr. HVK driving the motorbike did not pay attention, did not have a driver's license and had an alcohol concentration of 58.97 mg/100 ml of blood, causing the accident.
HVK's actions showed signs of crime in violation of regulations on road traffic prescribed in Article 260 of the Penal Code. On that basis, Go Vap District Police decided to prosecute the criminal case and transfer it to the People's Procuracy for approval.
