Ownership dispute
In recent days, public opinion has been abuzz with the incident of about 2 hectares of cashew trees in Da P’Loa commune, Da Huoai district (Lam Dong) being cut down. It is worth mentioning that this cashew garden is currently in dispute over ownership.
Initial information, Mr. Nguyen Van Hoac, residing in Da P'Loa commune, Da Huoai district, hired someone to cut down the cashew garden at the end of September 2024.
Meanwhile, Mr. Nguyen Giang Hai (residing in Ho Chi Minh City) confirmed that he is the owner of the cashew garden.
The situation became more tense when both Mr. Hoac and Mr. Hai presented evidence to prove that they were the real owners and legal users of the land and cashew garden.
On September 6, after receiving the information, Da P'loa Commune Police and land officials of this commune were present at the cashew garden and worked with relevant parties.
Owner not yet determined
According to the People's Committee of Da P'Loa commune, the government and relevant agencies have requested both parties to provide documents proving the legality of ownership and use.
Working with the authorities, Mr. Nguyen Van Hoac said that he had hired someone to cut down the cashew garden. Mr. Hoac also provided some papers and documents related to land use rights.
Among them, there is a plot of land that he said was the location of the cashew garden that he had just had someone cut down. Regarding the origin of the land, Mr. Hoac said it was transferred from Mr. Nguyen Quoc Thanh's household (residing in Dong Nai) in 2021.
Mr. Nguyen Giang Hai said that the land plot of about 2 hectares growing cashew trees is his.
Mr. Hai also provided some documents which are land use right certificates that he transferred from Mr. Nguyen Vinh Khuong's household (residing in Da Huoai district) since October 2017.
At the time Mr. Hai received the transfer, the land already had crops including fruit trees, rubber and cashew trees that had produced stable harvests.
However, because the house is in Ho Chi Minh City, after buying the land, Mr. Hai hired someone to look after it. In early September 2024, Mr. Nguyen Giang Hai received news that the cashew garden was completely cut down, causing damage of about 3 billion VND.
Mr. Hai reported Mr. Hoac to the authorities. The police of Da P'loa commune, Da Huoai district invited the accuser and the accused to work and make an initial record.
Mr. Dinh Cong Dinh - Chairman of the People's Committee of Da P'Loa commune said that according to initial verification, of the approximately 2 hectares of cashew trees that were cut down, about 1 hectare was included in Mr. Hoac's Land Use Rights Certificate.
Due to the lack of sufficient basis to determine who owns and uses the cashew garden that was just destroyed, the People's Committee of Da P'Loa Commune has requested all parties to keep the scene intact. In addition, the People's Committee has directed the Commune Police to ensure security and order and prevent disputes from occurring.
Currently, the People's Committee of Da P'Loa commune has reported the incident to the People's Committee of Da Huoai district for further direction and settlement according to regulations.
