The Ministry of Public Security sent documents to appraise the draft Law amending and supplementing a number of articles of 10 laws related to security and order.
Notably, in the project, the Ministry of Public Security proposed to amend a number of articles in the Law on Road Traffic Order and Safety.
In particular, the Drafting Committee made important proposals related to working hours of drivers of transport business vehicles, stipulated in the Law on Road Traffic Order and Safety.
According to the current Law, drivers are not allowed to drive for more than 10 hours a day, no more than 48 hours a week and no more than 4 hours a day.
However, the draft amendment removes the regulation limiting driving hours by day and week, only retaining the requirement of not driving continuously for more than 4 hours. Working hours during the day and during the week will be applied according to the Labor Code.
In addition, the draft Law on amending and proposing to amend and supplement a number of contents of the Law on Road Traffic Order and Safety. Some notable amendments are as follows:
Amend and supplement Clause 4, Article 34 as follows:
"Smart vehicles are motor vehicles that allow automation of all vehicle control activities, determine routes and handle situations when participating in road traffic".
Amend and supplement Clause 2, Article 35 as follows:
Traffic vehicles, tractor-trailers, ambulances, and internal transport vehicles must install journey monitoring devices and image recording devices for drivers. Passenger cars with 08 seats or more (excluding the driver's seat) used for transportation must have a device to record images of the passenger compartment".
Amend and supplement Clause 9, Article 57 as follows:
"The Minister of Public Security shall prescribe the model of driving licenses and international driving licenses, the order and procedures for granting and using international driving licenses and driving licenses; for the model of driving licenses, the order and procedures for granting and using driving licenses of the military and police forces performing national defense and security tasks shall be prescribed by the Minister of National Defense and the Minister of Public Security".
Amend and supplement a number of provisions of Article 61 as follows:
The driving test center is a unit providing driving test services; must meet the conditions prescribed by the Government and meet the technical requirements according to national technical regulations for road motor vehicle testing testing centers; must use equipment that applies information technology and must immediately share the results and data to monitor the testing process with the testing agency, issuing driving licenses for supervision, except when organizing driving tests for military and police forces performing national defense and security tasks.
Amend and supplement a number of points and clauses of Article 62 as follows:
"A driver's license is issued incorrectly or the granted person commits fraud to be issued, changed, or reissued a driver's license".
Amend and supplement Clause 6, Article 62 as follows:
The Minister of Public Security stipulates the conditions, order, and procedures for granting, exchanging, re-granting, and revoking driving licenses. The Minister of National Defense and the Minister of Public Security shall prescribe the issuance, exchange, re-issuance, and revocation of driving licenses for military and police forces performing national defense and security tasks. The Minister of Education and Training shall prescribe the conditions, order, and procedures for granting, exchanging, re-granting, and revoking driving certificates for specialized motorbikes for drivers of tractors with driving licenses as prescribed in Points d, e, g, h, i, k, l, m, and n, Clause 3, Article 89 of this Law".
