Proposal for new fine procedures from January 1, 2025

According to the draft, the procedure for handling traffic violations, including fines, will take effect from January 1, 2025.

The Ministry of Public Security is submitting the third draft of the Decree on administrative sanctions for violations of traffic order and safety in the field of road traffic; deduction of points and restoration of driving license points. The draft will take effect from January 1, 2025.

Article 47 of the Draft stipulates the procedure for sanctioning vehicle owners and drivers who violate regulations related to road traffic order and safety.

Clause 8, Article 47 of the draft stipulates the procedure for imposing fines as follows:

In case an administrative violation is detected through the use of professional technical equipment and means, but the competent authority has not yet been able to immediately stop the vehicle for handling, the competent authority shall send a notice requesting the vehicle owner and related individuals and organizations to come to the headquarters to resolve the violation.

Notification of fines is done electronically on the Traffic Police Department's website, on the application software managed and operated by the Traffic Police Department, or in paper form.

Vehicle owners who look up data on the Traffic Police Department's website or on the application software managed and operated by the Traffic Police force, if they have information about a violating vehicle or when receiving a written notice, are obliged to cooperate with the authorities to identify the subject who drove the vehicle and committed the violation:

In case the vehicle owner is an individual, if he/she does not cooperate with the authorities, cannot prove or explain that he/she is not the person who drove the vehicle and committed the violation, he/she will be punished for the discovered violation.

In case the vehicle owner is an organization, if it does not cooperate with the authorities and does not provide information to identify the person who drove the vehicle and committed the violation, it will be subject to administrative sanctions against the organization that committed the violation when discovered, except in cases where the vehicle is illegally appropriated or used.
