Nguyen Trong Nhan is the brother of defendant Duc, hoping that Duc would be handled lightly, knowing that Nguyen Van Binh is the Deputy Secretary of the Youth Union of Hiep Phuoc town, Nhon Trach district, and knew Dinh Tuan Anh as the Prosecutor who directly resolved the case, he asked Binh to meet Tuan Anh to talk.
About 16 hours, November 24, 2023, at a cafe, Nhan and Nhan's mother met Tuan Anh for help for Germany. Through exchanging, Tuan Anh threatened: The case moved to the provincial level, the sentence was very heavy, at least 7 years in prison, if you want to keep the settlement at the district level for a light sentence, you must bring 150 million VND to take care of. Nhan's family agreed with Tuan Anh's request, then Nhan went home to take 150 million dong into a black plastic bag and brought it to the cafe to give to Tuan Anh; Tuan Anh accepted money, bringing the agency to the cabinet to work.
Two days later, on November 26, 2023, Tuan Anh went to Binh's house to announce that he had kept the case to resolve at the district level and proposed to pay more for treatment to have a low sentence, with two levels of costs of 600 million VND for a prison sentence of 18 months to 20 months and 300 million VND for a prison sentence of 2 years to 2 years and 6 months. Nhan's family chose the cost of 300 million VND; Tuan Anh requested that the next day, November 27, 2023, 150 million VND must be paid in advance, the remaining amount will be reported a few days in advance when needed.
On the morning of November 27, 2023, Nhan transferred the amount of VND 100 million to Binh's account, then texted by Binh to withdraw cash to Tuan Anh. About 14 o'clock on the same day, Binh withdraw money and directly assigned Tuan Anh in front of the People's Procuracy gate of Nhon Trach district, and reported the remaining amount (VND 50 million) will be brought later. Tuan Anh accepted money, put it in the cabinet at the office.
Only the money was returned to the rich who was exposed
Through acquaintances, Nhan learned that Duc's case was only under the authority of the district level, not having to transfer the case to the provincial level as Tuan Anh said. Suspecting that he had been scammed, on November 29, 2023, Nhan texted Binh to ask Tuan Anh to return the money, with the reason that his family was in trouble and did not want to worry anymore. Binh texted Tuan Anh; at around 5:00 p.m. on November 30, 2023, Tuan Anh took 100 million VND and gave it to Binh to the People's Committee of Hiep Phuoc town.
Binh took 100 million VND to Nhan's house to pay him. Here, Binh called Tuan Anh to ask about the remaining 150 million VND, Tuan Anh replied that he had "used all of it to take care of keeping the records at the district level, not to mention it anymore".
After that, Nhan filed a complaint against the criminal acts of Tuan Anh and Binh and sent it to the Investigation Police Agency of Nhon Trach District Police. On December 1, 2023, Nhon Trach District Police transferred the petition to the Dong Nai Provincial People's Procuracy for settlement.
Based on the above details and evidence, the Supreme People's Procuracy recently concluded: Dinh Tuan Anh, for the purpose of profiteering, threatened and demanded that defendant Duc's family give him a bribe of VND450 million to reduce Ngo Dong Duc's criminal liability; from November 24, 2023 to November 27, 2023, Dinh Tuan Anh received VND 250 million from Duc's family twice. Nguyen Van Binh colluded and mediated for the defendant Duc's family to directly bribe Tuan Anh.
The Supreme People's Procuracy has prosecuted Dinh Tuan Anh for the crime of "Receiving bribes" and Nguyen Van Binh for the crime of "Bribery Brokerage".
