The Ministry of Agriculture and Environment has just issued a decision on announcing the standardization of administrative procedures in the land sector under the state management function of the Ministry of Agriculture and Environment.
According to the decision, the administrative procedures standardised in the land sector at the central level have 2 procedures; at the provincial level 42 procedures; at the district level 21 procedures; at the commune level 1 procedure.
Of which, 42 provincial-level administrative procedures are applied to many different groups of subjects such as domestic organizations, religious organizations, overseas Vietnamese, foreign-invested economic organizations and foreign organizations with diplomatic functions.
The main procedures include: Land allocation, land lease (with or not through auction, bidding), changing the purpose and form of land use, adjusting decisions related to land, volatile registration, granting land use right certificates, ownership of properties attached to land, extension of land use time, as well as resolving disputes and providing land data.
21 district-level administrative procedures include: Land allocation and lease without auctioning land use rights, not bidding to select investors to implement projects using land in cases where the investor is an individual who applies for investment policy acceptance and lease according to the provisions of the law on investment.
Allowing the change of land use purpose in cases where the investor is not approved in accordance with the provisions of the law on land, and the person applying for the change of land use purpose is a family or individual.
Adjust land allocation and lease decisions, allow change of land use purpose due to changes in the basis of land allocation and lease decisions, allow change of land use purpose for land users who are households or individuals...
This Decision replaces Decision No. 2124/QD-BTNMT dated August 1, 2024 of the Minister of Natural Resources and Environment on promulgating administrative procedures in the field of land under the State management of the Ministry of Natural Resources and Environment.
