Article 106, Decree 102/2024/ND-CP stipulates procedures for resolving land disputes under the authority of Chairmen of People's Committees at district and provincial levels
1. The person with a request for land dispute resolution shall submit the application to the People's Committee at the competent level.
2. The Chairman of the People's Committee at the competent level is responsible for:
a) Within 05 working days from the date of receipt of the application, it is required to notify in writing to the parties of land disputes and land registration offices or branches of land registration office, People's Committee of the commune where there is a disputed land on the acceptance of an application for land dispute settlement, in case of non -acceptance, in writing and clearly state the reason;
b) Assign responsibility to the consulting agency for settlement.
3. The advisory agency is responsible for verifying and verifying the case, organizing conciliation between the parties of the dispute, organizing a meeting of relevant departments and branches for advice on land dispute settlement (if necessary) and completing the dossier to submit to the Chairman of the People's Committee of the same level to promulgate a decision to settle land disputes. Land dispute settlement records include:
a) Application for land dispute settlement;
b) Memorandum of mediation at the People's Committee of the commune; Working minutes with disputes and related people; Minutes of inspection of disputed land status; The minutes of the meeting of relevant departments and agencies for advice on land dispute settlement in case of unsuccessful conciliation (if any); Reconciliation of conciliation in the process of dispute settlement;
c) Record of maps, cadastral records, photo data from remote records through periods related to the disputed land area (if any) and documents as evidence and evidence during the dispute settlement process;
d) Report the proposal and draft decision to resolve the dispute or draft decision to recognize successful mediation.
4. The Chairman of the People's Committee at the competent level shall issue a decision to resolve the dispute or a decision to recognize the successful mediation and send it to the disputing parties, organizations and individuals with related rights and obligations.
Thus, the procedure for resolving land disputes under the authority of the Chairman of the Provincial People's Committee is prescribed as above.
