According to the investigation of Lao Dong Newspaper reporters, the Long Van luxury housing project is invested by Long Van Company Limited, with an area of 1.1 hectares in Vo Cuong ward, Bac Ninh city. The project was allocated and leased land from August 2010.
The total investment capital of the project is 292.3 billion VND. The scale includes: Villa houses; luxury apartments; houses combined with services and auxiliary works.
This project was once concluded by the Bac Ninh Provincial Inspectorate to have many violations such as: At the time of inspection, no documents had been prepared for investment and construction; land use for the wrong purpose; failure to complete environmental and fire prevention and fighting documents and procedures; failure to fulfill financial obligations for land to the State budget.
The Inspectorate of Bac Ninh province proposed to reclaim land to implement the project.
This is also one of 58 projects that do not put land into use, are behind schedule in land use, and violate land laws in Bac Ninh province announced in early 2024.
Also according to the reporter's investigation, on February 11, the Standing Committee of the Bac Ninh Provincial Party Committee held the first conference in February 2025 to listen to and give opinions on 18 contents under its authority.
At the Conference, the Standing Committee of the Bac Ninh Provincial Party Committee listened to and agreed on the proposal on land recovery for the Long Van high-end housing project, due to not putting the land into use.
On February 12, the Chairman of the People's Committee of Bac Ninh province also assigned the Department of Natural Resources and Environment to coordinate with relevant agencies and units to urgently complete the report on the results of 1 year of implementing the Conclusion of the Provincial Party Committee Standing Committee on the results of inspection and review of projects that do not put land into use, are behind schedule in land use, and violate land laws in the province.
According to the 2024 Land Law, after being allocated or leased land, enterprises must put it into use for 12 consecutive months or be behind schedule for 24 months.
Otherwise, the investor will have a 24-month extension and pay the land use fee and land rent corresponding to the delay period.
After the extension period expires but the land has not yet been put into use, the State will reclaim it without compensation for the land and assets attached to the land.
Thus, it can be seen that the 2024 Land Law stipulates very clearly the project implementation period, if the progress is delayed, construction must be carried out within a maximum of only 48 months, including the extension period.
