During the process of paying bonuses to civil servants in the education sector according to Decree 73/2024/ND-CP dated June 30, 2024 of the Government, Ms. Pham Thi Hong (character's name has been changed) encountered some difficulties and problems. Therefore, she sent two questions to the Ministry of Home Affairs through the Ministry's Electronic Information Portal.
The first problem is, according to the provisions of Clause 2 and Point b, Clause 3, Article 4 of Decree 73/2024/ND-CP, the level of task completion for a year is calculated from January 1 to December 31 every year.
However, for the Department of Education and Training of Ms. District, the results of the assessment and classification of civil servants on the level of annual task completion are carried out according to the school year from September 2023 to May 2024.
"Compared with Clause 1, Article 6 of Decree 73/2024/ND-CP, will the assessment and classification results of the Education and Training sector of my district at the time of May 2024 be counted as the assessment and classification results of 2024 for the commendation according to Decree 73/2024/ND-CP?" - Ms. Hong wondered.
The second problem is that during the year, there are cases of staffing of cadres, civil servants, and public employees rotating between agencies and units. Is it allowed to calculate bonuses based on the actual working time at each agency and unit to calculate the bonus level of each individual?
Ms. Hong gave an example: Civil servant A worked at the District Youth Union from January 1, 2024 to September 30, 2024 (9 months), transferred to the District Economic and Infrastructure Department from October 1, 2024 (3 months).
Based on the rotation documents of civil servant A, the District Youth Union assessed the level of good task completion for the working time at the District Economic and Infrastructure Department.
Thus, based on the decision to classify civil servant A as having completed his/her tasks well, which agency will civil servant A receive a periodic bonus in 2024? How to calculate bonuses for civil servant A?
Regarding Ms. Hong's reflection and recommendation, the Ministry of Home Affairs responded on the Ministry's Electronic Information Portal.
According to the Ministry of Home Affairs, the bonus regime is stipulated in Article 4 of Decree No. 73/2024/ND-CP dated June 30, 2024 of the Government regulating the basic salary and bonus regime for cadres, civil servants, public employees and armed forces (the Ministry of Home Affairs issued Official Letter No. 7585/BNV-TL dated November 26, 2024 on the implementation of the bonus regime).
In particular, Clause 1, Article 4 stipulates the implementation of the bonus regime based on outstanding work achievements and the results of assessment and classification of annual task completion levels.
At the same time, Clause 2, Article 4 stipulates the authority to develop regulations to implement the bonus regime: Assign the head of the competent authority to manage or be delegated the authority to manage cadres, civil servants and the head of the public service unit to be responsible for developing specific regulations to implement the bonus regime applicable to subjects on the salary list of the agency or unit.
