I was granted a Certificate of Land Use Rights for the first time with 300 m2 of residential land, 2,000 m2 of perennial crop land, origin recognition of land use rights.
In 2025, I will convert the land use purpose to residential land by an additional 400 m2. The limit for residential land allocation in the locality for households when calculating land use fees according to regulations at the time of the decision allowing the conversion of land use purpose is 200 m2/person.
I asked, is the land allocation limit when changing land use purposes only calculated on the newly requested area (400 m2) or calculated in combination with the 300 m2 of residential land that has been recognized before?
After research, the Ministry of Agriculture and Environment answers this question as follows:
The fact that he was granted a Certificate of Land Use Rights for the first time has 300 m2 of residential land + 2,000 m2 of perennial crop land, the origin of recognition of land use rights.
Therefore, if he requests to change the land use purpose of the remaining part, the residential land allocation limit when changing the land use purpose will only be calculated on the newly requested area, the 300 m2 residential land that has been recognized by the State for land use rights.
