The Government Inspectorate has just issued a Notice of the Inspection Conclusion on the compliance with policies and laws for the Project to invest in the construction of Long Thanh International Airport (Long Thanh airport) phase 1.
The investment project to build Long Thanh airport phase 1 has a total investment of 109,111,742 million VND, including 4 component projects (DATP), project implementation time: 2020 - 2025. The scale and time were later adjusted but basically completed in 2025.
The investment objective is to build a project with 2 runways, 1 passenger terminal and synchronous auxiliary items with a capacity of 25 million passengers and 1.2 million tons of cargo per year.
The Inspectorate determined that the implementation of procedures for investors to approve projects, the capacity conditions of the Project Management Board (PMB), capital sources for DATP2, DATP3 implementation; the implementation of Package XD01, Package XD02 under DATP2 and Package 5.6, Package 5.10 under DATP3 still had shortcomings and violations.
Regarding the implementation of Package XD01, Package XD02 under DATP2:
The PMB approves the change of some materials and materials of other origin or without indicating origin compared to Contract XD02 when there are no price appraisal results; Vietnam Air Traffic Management Corporation (VATM) - signs an appendix to the material change contract (including materials not in the list of technical requirements for the main materials of the Package - Technical Instructions) when the contractor has not proven objective or force majeure reasons as prescribed in Contract XD02; quotes prices for materials and materials with inappropriate changes in the time of price appraisal, without brand and origin information (Construction Package XD02).
The dossier of acceptance of machinery and equipment for construction at the construction site does not have enough types of machinery and equipment compared to the Contract; some machinery and equipment have expired registration/inspection according to regulations. Contract and explanation of construction measures for some works are not consistent with actual construction (Construction Package 01, Construction Package02).
Contractor TCT 36 - JSC transferred to another contractor (the contractor has not been approved by the Investor to be a subcontractor) the work part under Package XD02 with a total value of 75,270 million VND, belonging to the act of contract transfer, violating the provisions of point a, clause 8, Article 89 of the 2013 Bidding Law. At the same time, consider according to the Joint Venture Contractor (the main contractor TCT 36-JSC and Newtatco are members of the joint venture) signing contracts with a number of other contractors to perform part of the work of Package XD02 with a total value of 99,000 million VND, belonging to the act of contract transfer, violating regulations.
Implementation of Package 5.6, Package 5.10 under DATP3:
At package 5.6: The joint venture contractor (with 3/6 main contractors being joint venture members including Hancorp, Vinaconex, Fecon Joint Stock Company) signed contracts with a number of other contractors (contractors not yet approved by the investor to be subcontractors) to perform part of the work of Package 5.6 with a total value of 87,162 million VND, belonging to the act of transferring contracts, violating the provisions of the Bidding Law.
At package 5.10: the bidding documents still have many errors, requiring many revisions. ACV purchased construction insurance that was not sufficient to the contract value.
The main contractor (NEWTECONS, RICONS, HANCORP, CCI, VINACONEX, ATAD, Phuc Hung) transferred to another contractor (the contractor has not been approved by the investor to be a subcontractor) the work part belonging to Package 5.10 with a total value of 1,596,101 million VND, belonging to the act of contract transfer, violating regulations.
The Government Inspectorate determined that the main responsibility for shortcomings and violations at DATP2, DATP3 belongs to the Investor (VATM Member Council, Board of Directors of Airports Corporation of Vietnam (ACV), General Director and Deputy General Director according to assigned tasks; Project Management Board, Expert Group, departments, boards and organizations, individuals directly related to VATM, ACV); Design consultant; supervision consultant; Construction contractor and related organizations and individuals.
Notably, the Government Inspectorate transferred information to the Ministry of Public Security to consider investigating and handling according to the provisions of law for a number of contractor transfer contractors and ACV investors who violated regulations.
At the same time, the Government Inspectorate transferred this Inspection Conclusion to the Ministry of Public Security for consideration of investigation and handling of violations in contractor selection and other violations in the bidding packages mentioned in the Inspection Conclusion related to criminal cases being investigated by the Investigation Police Agency of the Ministry of Public Security (if any) and issues related to important national projects and works under the authority and tasks assigned by the Prime Minister.
