The Ministry of Construction submits a draft Decree detailing a number of articles of the Construction Law on management of construction activities. The draft Decree takes effect from July 1, 2026.
The draft has regulations on dossiers requesting new construction permits.
Accordingly, for projects according to the route or projects not according to the route as follows:
Application for a construction permit according to the provisions of Form No. 01 Appendix II of this Decree.
One of the legal land documents for issuing a construction permit as prescribed in Article 56 of this Decree or a written approval from a competent authority on the location and route plan or a land recovery decision from a competent authority as prescribed by land law.
Decision approving the project; Report on the results of construction design appraisal as prescribed in this Decree (if any); results of administrative procedures according to the provisions of law on fire prevention and fighting and rescue for design dossiers requesting construction permits (if required).
Results of administrative procedures on environmental protection according to the provisions of the law on environmental protection (if required); written opinions of specialized agencies on culture at the provincial level (if required by the law on cultural heritage).
The set of construction design drawings in the construction design dossier deployed after the project is approved (construction drawing design for projects only requires preparing an economic - technical report) is approved or stamped with confirmation according to the provisions of the law on construction, including: the overall ground plan of the entire project, the positioning ground plan of the project on the land plot, architectural drawings of the ground plans, the main vertical and cross-sectional surfaces of the project (for projects not following the route) or the project route map, overall ground plan drawing or project diagram drawing, drawings of the main vertical and horizontal cross-sectional surfaces of the project route (for projects following the route); ground plan drawings, foundation cross-sectional drawings; drawings showing the main structural solution of the project; ground plan drawings connected to the technical infrastructure system outside the project.
For religious and belief works as follows:
The dossier requesting a construction permit for religious works includes documents as prescribed in Clause 1 of this Article and a written approval on the necessity of construction and scale of works from specialized agencies on beliefs and religions under the Provincial People's Committee.
The dossier requesting a construction permit for religious works includes documents as stipulated in Clause 1, Clause 2 and Point a, Clause 3, Article 61 of this Decree and written opinions from specialized agencies on culture at the provincial level (if required by law on cultural heritage); Report on the results of construction design appraisal for religious works that greatly affect safety and community interests.
Monuments and monumental paintings:
The dossier requesting a construction permit includes documents as specified in Clause 1 of this Article and a written approval of the necessity of construction and the scale of the project from the state management agency for culture.
For advertising works, implement according to the provisions of the law on advertising.
For works of diplomatic missions and international organizations:
The dossier requesting a construction permit for works of diplomatic missions, international organizations and foreign missions investing in Vietnam shall be carried out in accordance with the corresponding regulations in Clause 1 of this Article and the provisions of the Agreement or agreement signed with the Government of Vietnam.
