Other cases of land use combined with multiple purposes
Based on Article 9 of Decree 49/2026/ND-CP (effective from January 31, 2026) stipulating cases of land use combined with other multi-purposes as prescribed in Clause 4, Article 11 of Resolution 254/2025/QH15 as follows:
1. In addition to the cases of using land combined for multiple purposes specified in Clause 1, Article 218 of the 2024 Land Law, other cases of using land combined for multiple purposes include:
- Land types specified in Clauses 2 and 3, Article 9 of the 2024 Land Law are used in combination with the purposes of renewable energy, new energy; research, development, application of high technology, digital technology;
- Land for construction of non-business projects is used in combination with other non-business purposes, except for cases specified in Clause 3, Article 30 of the 2024 Land Law;
- Land for construction of public works is used in combination with public purposes for business purposes, except for cases specified in Clause 3, Article 30 of the 2024 Land Law.
2. The use of land combined with multiple purposes specified in Clause 1, Article 9 of Decree 49/2026/ND-CP shall be implemented as prescribed for land use combined with commercial and service purposes.
Types of land used for multiple purposes
Based on Clause 1, Article 218 of the 2024 Land Law, the following types of land are used in combination with multiple purposes:
a) Agricultural land used in combination with commercial, service, livestock, and medicinal plant purposes;
b) Land used for public purposes combined with commercial and service purposes;
c) Land for construction of public works used in combination with commercial and service purposes;
d) Residential land used in combination with agricultural, commercial, service, and non-business purposes for business purposes;
d) Land with water surface used in combination for multiple purposes as prescribed in Articles 188, 189 and 215 of this Law;
e) Religious land, religious land used in combination with commercial and service purposes;
g) Land specified in Clauses 2 and 3, Article 9 of this Law is used in combination with agricultural purposes, construction of postal, telecommunications, technology, information, outdoor advertising, and solar power infrastructure.
