Need a mechanism to handle common walkways when merging land plots
Sharing with Lao Dong reporters, Mr. Le Hoang Chau - Chairman of Ho Chi Minh City Real Estate Association (HoREA) - said that the draft regulation on conditions for land separation, land consolidation and minimum area for land separation in the city has many positive points but still needs to add some contents to be more suitable for reality.
According to Mr. Chau, the draft has quite reasonable regulations for the case of land plot separation, especially the content allowing the land area used as a common walkway for many land plots to be recorded in the form of common use on the land use right certificate.
However, in reality, many cases arise after land plots are combined into one large plot, then the common walkway is no longer necessary.
When land users merge land plots together, many cases no longer need to use the area as a common walkway. At that time, people want to merge this area into the land plot for common purposes" - Mr. Chau shared.
According to the Chairman of HoREA, the draft currently does not have specific regulations to handle this situation, so it is necessary to supplement a mechanism to allow the consolidation of common walkway land plots simultaneously with the recognition of land use rights or change of land use purpose according to legal regulations.

Mr. Chau said that this situation is not uncommon. For example, a large land plot is divided into many small plots with a common walkway in the middle. After a period of time, if these land plots are combined into a large plot, the area of the common walkway can be merged back to use as the original land.
Similarly, in some houses in dead-end alleys, if households want to merge land plots into a large land area, the common walkway may also need to change the purpose to become residential land and merge with surrounding land plots.
Proposal to apply the same area separation standard in the same area
Another content contributed by HoREA is the regulation on the minimum area for land plot separation for residential land.
According to the draft, the minimum area for plot separation in the central area is 36m2, with a frontage width and plot depth of no less than 3m.
However, according to Mr. Le Hoang Chau, to ensure fairness and synchronization between urban areas with similar conditions, it is necessary to rearrange some wards into the same group of areas applying the same minimum area standards.
Areas with similar urban conditions should apply the same area separation standard, avoiding disparities between adjacent areas, causing difficulties for people" - Mr. Chau said.
Land plot separation regulations need to be both strict and convenient for people
According to the Chairman of HoREA, regulations on land plot separation directly affect the rights of people as well as the transparency of the real estate market.
Therefore, policies need to ensure strict management according to planning, but at the same time must also create conditions for people to exercise their legitimate rights to land.
The addition of clear and practical regulations will help people easily carry out procedures, and also help management agencies facilitate the process of resolving dossiers" - Mr. Le Hoang Chau shared with Lao Dong reporters.
