The cost of converting rice land to perennial crop land depends on financial obligations related to local legal regulations and land conditions.
According to the 2024 Land Law, when converting rice-growing land to perennial crop land, you must pay land use fees.
- If you convert rice-growing land to perennial crop land and require a conversion permit, you must pay land use fees. This amount is calculated by the price difference between rice-growing land and perennial crop land according to the land price list issued by the provincial People's Committee at the time of implementation.
- In case of only needing to register changes (no need to ask for permission), no need to pay land use fee but still have to complete all procedures at the State agency.
According to Decree 35/2015/ND-CP, if you change the land use purpose from rice land, you need to pay a fee to support the protection and improvement of rice land. The fee usually ranges from 50 - 100% of the local rice land price.
In addition, you need to prepare additional costs for document appraisal, land surveying and mapping fees, land improvement fees, etc.
Speaking to Lao Dong reporter, lawyer Truong Anh Tu (TAT Law Firm) said: “To convert rice-growing land to perennial crop land, people need to submit an application for land use purpose conversion, land use right certificate, and current status drawing. Land use fee is calculated based on the price difference between rice-growing land and perennial crop land according to the land price list issued by the provincial People's Committee at the time of implementation”.
The lawyer also emphasized that the conversion can only be carried out if it is in accordance with the local land use planning. According to Decree 112/2024/ND-CP, rice-growing land in high-yield planning areas will not be allowed to be converted.
