This policy takes effect from August 10, 2026.
Accordingly, regulations on land support policies for ethnic minorities living in Can Tho City are in accordance with Clause 6, Article 16 of the Land Law No. 31/2024/QH15.
The subjects of application are agencies, organizations, and individuals related to the implementation of the above-mentioned policies; individuals who are ethnic minorities belonging to poor and near-poor households in ethnic minority areas; ethnic minorities in ethnic minority areas who do not have community living land.
Ethnic minority areas are identified according to Decision No. 60/QD-BDTTG dated January 29, 2026 of the Minister of Ethnic Minorities and Religious Affairs announcing the list of villages and communes in ethnic minority and mountainous areas, particularly difficult villages, communes in regions I, II, III in the period 2026 - 2030.
Conditions for land support
Individuals who are ethnic minorities are supported with land to ensure the following conditions:
- Must live and reside permanently in Can Tho City, certified by the residence registration agency at the time of considering individuals entitled to policies.
- Belonging to poor and near-poor households in ethnic minority areas.
- No residential land or commercial land, service land or non-agricultural production facilities land or agricultural land in the city for cases of initial land support corresponding to the type of land and form of support as prescribed in this resolution.
- Not yet entitled to housing support policies according to the provisions of housing law.
Support policies
Basically, it is divided into 03 cases:
1. For the first-time support case, Can Tho City allocates land within the limit according to regulations and exempts land use fees; allows the conversion of land use purpose to residential land within the limit and is exempt from land use fees; allocates agricultural land, without collecting land use fees with an area of no more than 5,000 m2.
In case there is no production land (agricultural land and non-agricultural land that is not residential land), but there is a need to lease non-agricultural land that is not residential land for production and business, land lease will be supported without auctioning land use rights, land rent will be reduced according to legal regulations, the leased area will not exceed 02 times the residential land allocation limit according to the regulations of Can Tho City People's Committee.
2. In case of land support to ensure stable life for ethnic minorities (who have been supported but lack or no longer have land), Can Tho City divides it into 02 forms of support.
If there is no more residential land, residential land is allocated or the land use purpose is changed from another type of land to residential land within the residential land allocation limit according to the regulations of the City People's Committee and is exempt from land use fees. In case there is a shortage of residential land compared to the residential land allocation limit, the land use purpose is changed from another type of land to residential land and is exempt from land use fees for the area within the residential land allocation limit.
For cases where there are no more agricultural land or the area of agricultural land being used is lower than the prescribed agricultural land support level, agricultural land transfer is supported, but the total area of land being used and the additional allocated area must not exceed 5,000 m2.
3. Ethnic minorities in ethnic minority areas that do not yet have community living land are allocated community living land areas to ensure a minimum area of 300 m2/land area for wards and a minimum of 500 m2/land area for communes in accordance with customs, habits, beliefs, cultural identity and actual conditions of the locality.
