Documents needed to receive compensation for residential land
People who complete the application for compensation when the State reclaims residential land (residential land) prepare the following documents:
Application for compensation and support.
red book, original pink book or notarized copy; map extract, land plot measurement extract (if any).
Documents proving rights and assets such as: Land use fee payment certificate, house records, construction works, assets attached to land.
Identification documents: Citizen identification card, Marriage registration certificate.
Authorize if the people authorize to receive money.
Documents proving that there are no other houses/land to be considered for resettlement.
Decision to reclaim land ( original or copy).
How to compensate when the State reclaims residential land
According to the 2024 Land Law, people who are using residential land recovered by the State and are eligible will be compensated with residential land, housing, money or land with other purposes depending on actual conditions.
No other residential land/housing in the commune or ward: arrange residential land or resettlement housing if the entire or remaining land is recovered below the minimum area.
For residential land or other houses in the same area: Compensation in money, or in residential land, housing, or other land (if the locality has a fund).
In case of not being eligible for compensation for residential land: Households and individuals who have to move their residence but are not eligible for compensation in the form of residential land, and have no other residence in the same commune/ward/etown, will be sold, leased, leased to buy a house by the State, or, allocated residential land with land use fees collected.
The selling price, rental price, housing rental price and land price when the State allocates land are determined by the Provincial People's Committee.
