Time to process documents for converting other land to residential land
According to Clause 40, Article 2 of Decree 01/2017/ND-CP, the time for processing dossiers on converting land use purposes from other types of land to residential land shall not exceed 15 days from the date of receipt of valid dossiers.
For mountainous areas, islands, remote areas or areas with difficult socio-economic conditions, the settlement time is not more than 25 days.
The above time does not include holidays and days off as prescribed and does not include the time the land user fulfills financial obligations.
Cost of converting to residential land
People must pay a number of fees including: Land use fees, registration fees, Certificate issuance fees and file appraisal fees.
Land use fee:
The land use fee to be paid depends on the current type of land, location, area, and land price list in the locality. Each province and city has a specific calculation method according to the provisions of the land law
For example, in the case of garden land, ponds adjacent to houses in the same plot of land (belonging to a residential area, previously not recognized as residential land), land use fee = 50% × (Land price - Agricultural land price) × Area.
In case of agricultural land allocated by the State (without collecting land use fees) converted to residential land: Land use fees payable = (Residential land price - Agricultural land price) × Area.
In case of non-agricultural land (not residential land) that the State has allocated or leased for a certain period of time, the formula will depend on the land price of the original land type and the remaining term
Registration fee = (Land price according to × Area price list) × 0.5%.
Red book issuance fee: Each locality has different regulations, usually not exceeding 100,000 VND.
dossier appraisal fee: Issued by the Provincial People's Council.
