According to Clause 5, Article 116 of the Land Law 2024: "The basis for allowing the change of land use purpose agricultural land in residential areas, agricultural land in the same plot with residential land to residential land or changing the use purpose of non-residential non-agricultural land to residential land for households and individuals is the district-level land use planning or general planning or subdivision planning according to the provisions of the law on urban planning approved by the competent authority."
Thus, according to the Land Law 2024, the basis for allowing the change of agricultural land use purpose to residential land is the district-level land use planning.
According to Article 62 of the Land Law 2024, the period of land use planning and land use plans are regulated as follows:
- The period and vision of national land use planning, defense land use planning, and security land use planning are implemented according to the provisions of the Planning Law.
- The period and vision of provincial land use planning are consistent with the period and vision of provincial planning.
- The period of district-level land use planning is 10 years. The vision of district-level land use planning is 20 years.
- The period of national land use plans and provincial land use plans is 5 years; district-level annual land use plans are made annually.
From the above regulations, the period of district-level land use planning is 10 years, with a vision of 20 years; district-level annual land use plans are made annually. Accordingly, the Land Law 2024 has simplified the conditions for changing the use purpose of agricultural land to residential land.
